ASSUMPTION OF RISK AND WAIVER OF LIABILITY

By signing this waiver, I acknowledge that the use of inflatable amusement equipment, including but not limited to bounce houses, water slides, obstacle courses, and other inflatable play structures (collectively "Equipment"), involves inherent risks of physical injury. These risks include, but are not limited to, falls, collisions with other participants, contact with the Equipment's surfaces, overexertion, and sprains or fractures.

I voluntarily assume all risks associated with the use of the Equipment for myself and for any minors listed below for whom I am the parent or legal guardian. I agree to supervise all minor participants at all times during the use of the Equipment.

I agree to follow all safety rules and operational guidelines provided by Inflated Expectations, including but not limited to the rules listed below. I understand that failure to follow these rules may result in injury and may void this waiver.

I acknowledge that adult supervision is required at all times while the Equipment is in use. At least one responsible adult (18+) must be present and actively supervising participants. I agree that I am responsible for ensuring that all participants comply with the safety rules.

I confirm that all participants meet the age and weight requirements specified for the rented Equipment. I will not allow participants who do not meet these requirements to use the Equipment.

In consideration of being permitted to use the Equipment, I hereby release, waive, discharge, and covenant not to sue Inflated Expectations, its owners, officers, employees, agents, and representatives from any and all liability, claims, demands, and causes of action arising out of or related to any loss, damage, or injury that may be sustained during the use of the Equipment.

NOTICE UNDER NEW YORK LAW: This waiver does not waive any rights in cases of gross negligence, reckless conduct, or intentional wrongdoing by Inflated Expectations or its agents. New York General Obligations Law Section 5-326 may affect the enforceability of certain provisions of this agreement. Nothing in this waiver shall be construed to limit any rights provided under applicable New York State law.

EQUIPMENT DAMAGE AND CARE RESPONSIBILITY

I understand that I am responsible for the care of the Equipment from the time of delivery/setup through the time of scheduled pickup. I agree to the following:

• I will not allow the Equipment to be used in a manner inconsistent with its intended purpose or in violation of the safety rules below.
• I will not allow silly string, paint, markers, gum, tape, stickers, sharp objects, or any substance that may stain, puncture, or damage the Equipment.
• I will not attempt to move, relocate, or modify the Equipment or its anchoring once it has been set up.
• I am responsible for powering off the blower and securing the Equipment in the event of severe weather or wind exceeding 15 mph.

I acknowledge that if the Equipment is returned in a damaged condition beyond normal wear and tear, I will be responsible for the cost of repair or replacement. Inflated Expectations will document any damage with photographs and provide an itemized statement of repair costs. I authorize Inflated Expectations to charge the payment method on file for verified damage costs. Examples of chargeable damage include, but are not limited to:

• Tears, punctures, or cuts to vinyl surfaces: $75 - $250 depending on size and location
• Staining from paint, silly string, or markers requiring professional cleaning: $50 - $150
• Damage to mesh netting or windows: $100 - $300
• Missing or damaged stakes, tarps, or accessories: replacement cost
• Damage requiring full unit replacement: up to full replacement value

No damage charge will be applied without photographic documentation and a written description of the damage provided to the signer at the email address listed below.

I have read this waiver in its entirety and understand its contents. I am signing this waiver voluntarily and intend it to be a complete and binding release of all claims.
